These Terms and Conditions ("Terms") govern your use of the website www.moccamalabar.com (the "Site") operated by Mocca Malabar Coffee, based in Basel, Switzerland ("we", "us", "our"), and, where a separate wholesale agreement is not in place, the general terms of our sourcing and export services. By using the Site or engaging our services, you agree to these Terms.

1. About us

Mocca Malabar Coffee sources and exports specialty-grade green coffee from the Western Ghats, India, and select partner origins, primarily for wholesale roasters. We are based in Basel, Switzerland. You can reach us at moccamalabar@gmail.com or +41 79 000 00 00.

2. Use of this website

  • The content on this Site (text, images, logos, layout) is provided for general informational purposes about our company and offerings.
  • You may not copy, reproduce, or use content from this Site for commercial purposes without our prior written consent.
  • You agree not to misuse the Site, including attempting to gain unauthorised access, introducing malicious code, or submitting false information via our contact form.
  • We aim to keep the Site accurate and available but do not guarantee uninterrupted access, and may modify or remove content at any time.

3. Enquiries, samples, and quotations

Information submitted through our contact form (e.g. volume, flavour preferences) is used solely to prepare a tailored response, sample offer, or quotation. Submitting an enquiry does not create a binding contract. Coffee availability, pricing, and lot allocation are confirmed only once agreed in writing (e.g. by email or signed contract/purchase order).

4. Wholesale orders and contracts

Any wholesale sale of green coffee is governed by the specific terms agreed between Mocca Malabar Coffee and the buyer at the time of contract (covering price, Incoterms, quality specification, quantity, packaging, and delivery/shipping timeline). Where such a specific agreement exists, it takes precedence over these general Terms in case of conflict. Unless otherwise agreed in writing, standard trade practices for green coffee (e.g. as reflected in Green Coffee Association or ECF contract norms) apply as a general reference framework.

5. Pricing and payment

Prices quoted are indicative until confirmed in a written offer or contract and are typically expressed in USD, EUR, or CHF depending on the transaction. Payment terms, currency, and Incoterms will be specified in each order confirmation or contract.

6. Quality, samples, and claims

We provide cupping notes and physical/quality specifications in good faith based on pre-shipment or representative samples. Natural variation in agricultural products means minor deviations between sample and shipment can occur. Any quality claim must be raised within a reasonable period after arrival, as specified in the relevant contract, together with supporting evidence (e.g. an independent cupping or lab report).

7. Intellectual property

All trademarks, logos, and content on this Site, unless otherwise credited, belong to Mocca Malabar Coffee or are used with permission. Nothing on this Site grants you a licence to use our intellectual property except as necessary to view the Site in a standard browser.

8. Limitation of liability

To the extent permitted by Swiss law, Mocca Malabar Coffee shall not be liable for indirect, incidental, or consequential damages arising from use of this Site, except in cases of intent (Vorsatz/dol) or gross negligence (grobe Fahrlässigkeit/faute grave), where liability cannot be validly excluded under Swiss law (Art. 100 CO). Liability related to actual wholesale transactions is governed by the specific contract terms for that transaction.

10. Governing law and jurisdiction

These Terms are governed by the substantive laws of Switzerland, excluding its conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), unless expressly agreed otherwise in a specific wholesale contract. The exclusive place of jurisdiction for any dispute arising from these Terms is Basel, Switzerland, subject to any mandatory consumer-protection jurisdiction rules that cannot be excluded by agreement.

11. Changes to these Terms

We may update these Terms from time to time. The "last updated" date at the top reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the revised Terms.
